ившия кмет на столичния район „Младост“ Десислава Иванчева ще лежи шест години в затвора, след като Върховният касационен съд излезе с окончателна присъда по делото й за подкуп и изнудване. То беше образувано след показния ѝ арест през 2018 г.
За присъдата съобщи самата Иванчева в профила си във Facebook тази сутрин. Решението на съда е взето в закрито съдебно заседание на 9 ноември и пълният текст, както и мотивите към него, все още не са публикувани.
„Приятели, осъдена съм на 7 години. След 30 минути заминавам за затвора в Сливен“, написа тя. Според решението на ВКС, което предстои да бъде публикувано, нейната присъда е 6-годишна. Осъдените като помагачи Биляна Петрова и Петко Дюлгеров получават съответно 5- и 4-годишна присъда. Днес в затвора в Сливен е откарана и Биляна Петрова, съобщи Би Ти Ви.
По-късно Иванчева пусна и няколко видеоклипа, от които се вижда как се подготвя да бъде отведена в затвора и самото отвеждане. През ноември миналата година тя роди дете, но и това не промени решението на съда.
В началото на юли 2020 г. Апелативният специализиран съд намали присъдите на бившия кмет на „Младост“ Десислава Иванчева, заместничката й Биляна Петрова и на обвинения за посредник и помагач Петко Дюлгеров съответно на 8, 7 и 6 години лишаване от свобода. Те бяха осъдени от първоинстанционния специализиран съд съответно на 20, 15 и 12 години затвор за поискан подкуп от строителния бизнесмен Александър Ваклин.
На втора инстанция съдът прие за доказано, че Десислава Иванчева не само е поискала от строителния предприемач Александър Ваклин подкуп от 178 хиляди и 500 евро, а Биляна Петрова и Петко Дюлгеров са били помагачи в това деяние, но е и получила „неследващия й се дар“ в размер на 70 хил. евро. Първоинстанционният съд бе приел за доказано, че Иванчева е поискала подкупа, но не го е получила.
Всички подсъдими по делото поискаха да бъдат оправдани на последна инстанция, като посочват множество основания – съществени нарушения на процесуалните правила, нарушения на материалния закон и явна несправедливост на наложените наказания. Прокуратурата от своя страна настояваше за увеличаване на присъдите на всички подсъдими.
Присъдите и на тримата подсъдими са окончателни и не могат да бъдат обжалване. Иванчева и Петрова останаха в ареста за максималния срок от 8 месеца след задържането, а след това съдът ги пусна под домашен арест. Те останаха с тези мерки до лятото на 2021 г. Срокът и на двете мерки за неотклонение обаче се счита за изтърпяно наказание и ще бъде приспаднат от окончателната присъда.
По време на делото Иванчева правеше опити за инвитро, а миналата година роди. Иванчева и Петрова ще могат да поискат условно предсрочно освобождаване като по закон това може да се случи след като са изтърпели половината от присъдата и ако могат да дадат доказателства за поправянето си. Освен това е нужно и становище на затворническата администрация, която следи различни показатели за поведението на осъдените – полагане на труд в местата за лишаване от свобода, социални дейности и др.
Междувременно от гражданското обединение в защита на Десислава Иванчева и Биляна Петрова съобщиха, че днес в 18:30 ч. организират протест пред Съдебната палата. На него щели да бъдат припомнени „най-категоричните факти свързани с тяхното набедяване в подкуп“. „Довечера ще ви съобщим какви ще бъдат следващите наши действия срещу несправедливото им осъждане от сменения по поръчка на Иван Гешев съдебен състав на Върховния касационен съд“, се казва в съобщението до медиите от днес
